What is a Wrongful Death Claim?

If a family loses a member in a motorcycle accident because of another party’s recklessness or negligence, surviving family members may have grounds for a wrongful death action. Examples of negligence that may lead to a fatal incident and wrongful death claim may include failure to yield the right-of-way to motorcyclists, speeding, not checking blind spots for bikers who are lane splitting, driving under the influence of alcohol or drugs, and more. The purpose of this type of case is to reimburse survivors for economic and non-economic damages to make them whole again.

To bring a successful wrongful death action forward, claimants must prove four elements. This includes duty, breach of duty, causation, and damages. In other words, there must be clear and compelling evidence that demonstrates that the defendant owed a duty of care, that duty was breached through their negligence, the breach of duty was the direct cause of the fatal incident, and that the loss of life generated damages that survivors must recover. Evidence may include police reports, eyewitness accounts, testimony from expert witnesses, video surveillance footage, and other documentation.
