What is Wrongful Death and How is it Proven?

A wrongful death may happen for various reasons. In some cases, one party or entity may be held liable for the loss of life. In other situations, two or more parties may share liability for the incident. Proving liability in a fatal motor vehicle crash requires clear and compelling evidence surrounding the loss of life and how it happened. Evidence is necessary to back a case up and provides the connection between the other side’s negligence and a loved one’s death. Examples of evidence that an accident attorney can use to prove wrongful death include traffic incident reports, photographs of the incident scene, medical reports, statements by eyewitnesses, and more.

Is There a Time Limit on Wrongful Death Cases?

The immediate family of the decedent generally has priority in filing wrongful death cases. This includes the spouse, domestic partner, and children. Other relatives may be eligible if such relationships do not exist. Family members must file within the two-year statute of limitations.
