Things Survivors Should Know About Wrongful Death Car Accident Cases

A wrongful death may occur when a person suffers fatal injuries in an incident caused by someone else’s negligent actions. The sudden loss of a close relative may result in a deep emotional void and also lead to great financial hardship for the family. As a surviving family member, you deserve to obtain justice and financial compensation for the loss of your loved one and the losses incurred. This may come in two forms: economic damages and non-economic damages. Before a loved one passed away, they may have received medical treatment for their final injuries. You may seek reimbursement of end-of-life care costs through a survival action.

Other recoverable damages may include expenses for funeral and burial services, mental anguish, lost companionship, lost future expected earnings by the decedent, loss of support, care, and love, and more. Keep in mind that each wrongful death claim is unique. Therefore, the losses you may recover will differ from what another family will receive. An experienced Pleasanton wrongful death attorney can review the facts and circumstances of your case to determine the damages that may be recovered in your situation.

Various factors may influence the value of a wrongful death claim. Your accident attorney will work to ensure that all applicable damages are factored in when seeking financial compensation for the loss of your loved one. This includes the decedent’s age, health, education, job status, life expectancy, and family duties. Expert witness testimony may be necessary in these cases to prove that the damages are reasonable and necessary in addition to their value. For instance, an economist may be retained to provide insight into the decedent’s occupation, and future expected earnings.
