Family Hit While Crossing Watt Avenue

I am Ed Smith, a Sacramento Personal Injury Lawyer. In the afternoon on May 25, 2017, a Mother and her three young children were hit while crossing the street near the intersection of Watt Avenue and Arden Way near Arden Middle School. I hope for a speedy recovery for all those injured in the accident.

What Happened

The California Highway Patrol (CHP) reports that in the late afternoon, a mother around 30-years-old, was crossing the street with her three younger children outside of a designated crosswalk. They safely crossed the southbound lanes and over the median before continuing across the other lanes of traffic. It was then that a driver of a 2011 Toyota Corolla failed to see the family crossing and hit the young mother and children.

The Result

The youngest child, a 3-year-old boy, was in a stroller and was not hurt during the incident. The 4 and 6-year-old daughters suffered major injuries and were transported to UC Davis Medical Center for treatment. The mother suffered a few moderate injuries during the incident. All of Watt Avenue northbound lanes were closed for about 25 minutes while the scene was cleared by the authorities. The CHP is still investigating the crash and no other details have been released at this time.

Pedestrian Accidents

Pedestrian accidents can lead to traumatic injuries. It falls to both the driver and the pedestrians on the road to exercise a duty of care and obey all traffic laws. This does not indicate that a pedestrian that is outside of a crosswalk area is automatically at fault. As long as the pedestrian is exercising all reasonable precautions while a driver of a vehicle acts in an illegal and reckless way, the jury may side with the pedestrian in a court case. Furthermore, drivers should be able to make the assumption that a pedestrian is going to act in a way that is in obedience to traffic laws and exercise their duty of care.
