Injuries Suffered in Bicycle Accident at Hazel Avenue Intersection

A bicycle accident involving a vehicle occurred in Fair Oaks on December 19 with minor injuries. The collision was reported by the California Highway Patrol (CHP) as happening at the Hazel Avenue intersection with Sunset Avenue around 3:01 p.m. and involved an AT&T work truck. Information was not provided on whether the injured bicyclist was transported to a hospital. An investigation is underway by the CHP to determine whether the bicycle rider or driver was at fault for the accident.

Liability in Accidents Caused by a Business Vehicle

Businesses must take responsibility for any accidents caused by their vehicles. Liability in these cases can vary depending on the legal jurisdiction, as well as the details of the incident. Typically, a business will be liable if one of its employees was operating a company vehicle at the time it struck and injured a bicycle rider. This could include a car, truck or any other type of vehicle operated for business purposes.

Liability for Lack of Maintenance in a Business Vehicle

In some cases, a business may be liable even if an employee was not driving the company vehicle at the time of the bicycle accident. For instance, if the vehicle was being operated by another driver and caused damage to property or injury to people due to negligence on behalf of the business (such as failing to properly maintain the vehicle or provide adequate safety training). Additionally, if a business fails to insure its vehicles, it may be liable for any damages caused in an accident.

How an Injury Lawyer Can Help Recover Compensation

If you’ve been injured in a bicycle accident caused by a business vehicle, an injury lawyer can help you recover compensation for medical bills, wages that were unpaid because of your trauma and other damages. An attorney will review the details of your case and determine what type of compensation you may be entitled to. They will also assess the level of negligence on behalf of the business and ensure that you receive the maximum compensation possible.

An experienced injury lawyer can also negotiate with insurance companies and other parties involved, helping to ensure a fair settlement. With the help of an attorney, you can make sure that your rights are protected and get the justice you deserve. Recoverable compensation in a personal injury claim may include:

  • Recovery of all medical expenses caused by the bicycle accident, including the fee for the ambulance, hospitalization, surgeries and rehabilitative care.
  • When you cannot work and don’t get paid for lost time, that is recoverable in a personal injury claim. Recovery of wages also includes lost insurance coverage, pension benefits and others.
  • Damages can be recovered for pain and suffering. Compensation does not only include your physical pain. Many people who have been injured in a bicycle collision with another vehicle experience both emotional and psychological pain. A surprising number end up developing post-traumatic stress disorder (PTSD), for which professional treatment is required.
