Determining Liability in a Traffic Collision

When multiple vehicles are involved in a traffic crash, determining liability can be challenging. To determine who is ultimately liable for damages resulting from an accident, the facts of the case must be reviewed along with the laws of the state. Fault is generally assigned according to negligence principles. A driver who violated a traffic law or was less careful than another can be held responsible for the accident.

Compensation for Fatalities and Injuries in Accidents

A traffic crash may entitle you to compensation if you were injured or lost a loved one. To determine who is legally responsible for your accident and whether their negligence resulted in your injuries or the death of a loved one, the first step in a personal injury claim is to identify who is legally responsible. Depending on the circumstances, a third party, such as another driver, a government entity for poor road maintenance, or a product manufacturer, may be responsible for paying you.

Claims After a Traffic Collision

It will be necessary for you to file a claim against the responsible party and their insurance company in order to receive compensation. A person filing a personal injury claim must provide evidence of negligence, which your lawyer can gather, including witness testimony, the police report and accident scene photos. Additional proof of damages, such as medical records and lost wages, may also be required.

Similar processes apply when pursuing a wrongful death claim. For the family to be compensated, it is necessary to provide proof of lost wages and future earnings, pain and suffering, funerals and burial expenses, and others.
