Investigation Being Conducted to Determine Fault in Pedestrian Fatality Accident

The driver that struck the woman remained at the accident scene. The investigation into the cause of the fatal collision is active as investigators determine how it happened.

An Action for Wrongful Death After a Pedestrian Fatality

When a pedestrian is killed in an accident, a family seeking compensation must have the evidence needed to support their claim. When someone dies due to the negligence or misconduct of another, that person or entity can be held liable for damages. This allows the immediate family members to file a claim for wrongful death to recover compensation for their loss.

Wrongful Death Evidence Recovery

Injury attorneys can investigate a pedestrian fatality accident to determine whether the evidence supports wrongful death claims. Collected evidence includes the police report, interviewing any witnesses to the collision, looking for traffic surveillance videos, and photographing the accident scene. An expert witness may also testify concerning the cause of death and the at-fault party’s negligence.

Getting in Touch With a Wrongful Death Lawyer

You should contact an injury attorney following a pedestrian fatality accident to make a successful claim for wrongful death. An attorney can help you gather evidence and evaluate its strength to ensure that all aspects of your case are considered. As well as learning your legal rights, you can also learn how to pursue a successful claim.

Wrongful Death Damages That Are Recoverable

A wrongful death lawsuit can recover a number of damages, including the following:

  • Expenses associated with funerals and burials can be recouped.
  • Wages, pensions and insurance benefits of the deceased can be recovered until their normal retirement age.
  • Loss of guidance, advice, love, protection and moral support may be claimed after the death of a loved one.
  • Loss of consortium may be claimed by the surviving spouse.
  • The deceased may have provided household services that can be recovered.

In order to file a claim for wrongful death, you have a limited timeframe. In some cases, the decedent was unmarried and had no surviving children. The parents and siblings of an individual may be able to make a claim in such a case. By contacting an accident attorney for a free consultation, you can learn more about the process, have your case reviewed and find out what options are available.
