Types of Wrongful Death Damages in California

A wrongful death claim is intended to seek and provide compensation to a family who has lost a loved one due to the negligence of another. They take financial and intangible harms into account as a way of making a family whole. Compensation through these cases come in two types: economic damages and noneconomic damages. A Stockton wrongful death lawyer will work to obtain these wrongful death damages on a family’s behalf:

  • End of life medical care and expenses
  • Funeral and burial bills
  • Loss of future financial support and benefits
  • Lost of affection, comfort, and companionship
  • The value of household services that the lost loved one provided to the family

While the thought of putting a price on a loved one’s wrongful death may be challenging and overwhelming, compensation from a wrongful death case can help bring justice and peace of mind. This can allow you and your family to focus on grieving and recovering from your loss by covering unexpected expenses and planning for a more secure future. Establishing the fair value of a claim can only be done through the compassionate and experienced representation of a Stockton wrongful death lawyer. Does Insurance Cover Wrongful Death for a Stockton Hit and Run Crash?

Traffic accidents can be stressful and overwhelming events. This is especially true if a loved one’s life was claimed in the crash, and the at-fault party fled the scene. Survivors are often left to pick up the pieces on their own, with no guarantee that the suspect driver will ever be found and held accountable for their actions. If a family finds themselves dealing with a wrongful death hit and run, it is essential to know that recourse may be available in their situation. The uninsured motorist provision of a lost loved one’s insurance policy may be used to help cover wrongful death damages. If the relative did not have insurance but lived with someone who did, an uninsured motorist claim may also be filed for the fatal hit and run, so long as the decedent was not excluded from the policy.

What is the Filing Deadline for a California Wrongful Death Claim?

Wrongful death lawsuits are subject to a two-year statute of limitations in California. This means that these cases must be filed with the court within two years of a loved one’s wrongful death. Other factors may affect the statute of limitations in a wrongful death claim. If a case involves negligence on the part of a government entity in California, a notice of claim must be filed within 180 days or six months. If the lawsuit is not brought within the appropriate filing deadline, the court may dismiss the case, and the family may lose the right to recover compensation. An experienced attorney can help in these situations by understanding how California laws apply to each family’s case and file lawsuits based on applicable criteria and deadlines.
