Critical Injuries Reported in Modesto Car Accident

I’m Ed Smith, a Modesto car accident lawyer. Two parties suffered critical injuries after being pinned inside their vehicle due to a car accident near northeast Modesto on July 21, 2018. Personnel from the Stanislaus Consolidated Fire Protection District and Modesto Police Department responded to a report of a traffic accident along Claus Road in the vicinity of Santa Fe Avenue shortly after 6:15 p.m. Upon arrival, emergency personnel worked to extricate the driver and passenger of a Lincoln Town Car sedan. The two parties were later transported by ambulance to an area hospital for treatment of serious injuries. An update on their condition has not yet been released by officials.

Accident Investigation

A preliminary report by Modesto police suggested that the accident occurred when a Lincoln Town Car reportedly ran a stop sign at the intersection of Santa Fe Avenue and Claus Road. When this happened, the Lincoln was struck by a Range Rover traveling southbound along Claus Road. The impact caused the Lincoln to lose control, overturn and come to a rest in a ditch near the railroad tracks. Railroad dispatchers were notified to stop trains in the area as emergency crews were extricating the victims out of the Lincoln. Additional details surrounding the cause of the accident have not yet been released by investigators.

Passenger Injury Claims

When a passenger suffers injuries in a car accident, that passenger may be able to bring a claim against multiple insurance policies depending on the circumstances of the crash. For instance, if the vehicle the passenger was riding in was struck by a car that ran a red light, that passenger may file a claim against the insurance policy of the at-fault driver. In the event of an accident being caused by an uninsured motorist, the passenger may seek recourse through the insurance policy of the vehicle they were riding in so long as that policy has Uninsured/Under-Insured Motorist Protection (UM). How a Personal Injury Attorney Can Help

When a car accident causes a passenger to suffer serious injuries, that party may have the right to bring a claim for damages incurred. These may include all reasonable and necessary expenses related to an accident such as medical bills, time lost from work and other damages. In order to recover compensation as a passenger, a link between the negligent act and injuries sustained must be proven. This can be done by compiling a collection of evidence such as traffic collision reports, area of damage sustained, the position of the vehicles, tire marks, witness testimonies, medical records and more. Contacting an experienced personal injury attorney in Modesto is crucial following an accident as necessary evidence in filing a personal injury claim can fade over time.
