The vehicle driver that struck the bicycle rider remained at the collision scene and cooperated with authorities conducting the investigation. Police say that drunk driving was not a factor in the collision. The area along Sylvan Road from Greenback Lane to Stock Ranch Road was shut down while the investigation was conducted and reopened at about 7:00 p.m.

Bringing a Wrongful Death Claim After a Fatal Accident

Family members of the deceased may be able to file a claim for wrongful death if a reckless driver is found to have caused the Citrus Heights cyclist crash. It is intended to compensate the family for losses from the death. Immediate family members such as the spouse and decedent’s children may file, or another option is the executor of the deceased person’s estate. If the deceased had no spouse or children, other family members, such as the siblings and parents, may choose to file a claim.

Statute of Limitations

The statute of limitations to file a wrongful death claim in California must be made within two years of the accident dates. The court will refuse to consider late claims. Because evidence must be collected to support a family’s claim, which can disappear or be covered over, getting in touch with an accident attorney soon afterward can make a difference in whether the case is concluded successfully.

Getting Compensation for a Wrongful Death

Depending on the decedent’s circumstances, the family can file a wrongful death claim and seek damages for funeral expenses and other financial losses, including wages, until the deceased person’s retirement age. Compensation may also be sought for the spouse’s loss of consortium and for the pain and suffering of the family members. Household services the decedent provided around the house may also be recoverable since the family may have to pay for them in the future.
