Major Injury Collision Investigation Underway

At least one major injury occurred in the accident. That person was transported to a hospital nearby for medical care. The investigation into the cause of the two-vehicle crash is underway by the CHP traffic collision unit.

Identifying the Responsible Party in an Intersection Crash

For an injured party to receive proper compensation after a major injury collision, it is essential to determine liability. Investigation into such situations usually involves gathering evidence, such as photographs, witness statements, and police reports, to determine liability. Further, it may also be necessary to analyze traffic laws to establish who had the right-of-way or was responsible for yielding to oncoming traffic.

Those at fault for an intersection accident may be responsible for any injuries and/or property damage they cause. Drivers who fail to yield the right of way in a major injury collision are generally considered negligent and, thus, responsible for the accident victim’s injuries or damages. Furthermore, the driver who enters an intersection against a stop sign or red light will also be responsible for any damages resulting from the violation.

Compensation Recoverable in a Personal Injury Case

Injuries can result in various damages that can be recovered through a personal injury claim. An injury lawyer can provide a better understanding of what compensation you may receive, however, since a number of factors can affect it, such as the injured party’s income and age. You can also get help calculating your losses from the lawyer. The following damages are included:

  • Medical: Amounts paid to medical professionals and other expenses incurred due to the injury are recoverable.
  • Any lost wages, including pensions, insurance benefits, bonuses, etc. can be claimed.
  • Pain and suffering caused by the accident are recoverable, including physical trauma and emotional problems, such as depression, sleeplessness and anxiety.
  • Loss of consortium: Companionship or consortium losses can be recovered if the injury causes a life-altering disability that interferes with a couple’s relationship.

The injured may seek economic and non-economic damages in a personal injury claim when injured in an accident caused by another’s negligence. It is the intent of compensable damages to assist injured parties in returning to their pre-accident state as closely as possible. An injury lawyer can assist those who have been injured by someone else’s negligence in obtaining fair compensation for their losses.
