Investigators in a preliminary release indicated that the crash involved a service vehicle and a Ford pickup truck. The service vehicle was traveling northbound on James Road and reportedly had a posted stop sign. The Ford truck was traveling eastbound on Manning Avenue approaching the intersection, which did not have a posted stop sign for them, officials said.

The service vehicle allegedly broadsided the right side of the Ford, which propelled the vehicle into a field in the area, CHP traffic officers reported. The service vehicle driver was uninjured, officials said. The Ford driver sustained injuries described as minor in the crash.

Sadly, a passenger in the Ford, Jeff Mullhofer, 48, of Bakersfield, was declared deceased at the crash site. A GoFundMe page has been set up for the Mullhofer family. Additional information on the two-vehicle crash was unavailable.

What is Involved in a Wrongful Death Case for a Fatal Accident?

The loss of a close relative is painful. When that death was the result of someone else’s carelessness or negligence, the grief is only multiplied. Under California law, a wrongful death action may be filed to seek reimbursement for losses for the loss of life caused by the negligence or carelessness of another party or entity. Recoverable damages in these cases are intended to recognize the immense loss survivors have endured and to make them whole again. These may include lost earnings, loss of companionship, mental anguish, funeral costs, medical bills (via survival action), and more.

There is a two-year statute of limitations placed on wrongful death cases in California. This time limit starts on the date of the fatal incident in question. Exceptions may apply. For instance, if a fatal accident involving a government agency, the deadline is six months instead of two years. This is outlined in the California Government Code Section 911.2. This means a notice of claim must be filed no later than six months from the date of the fatal incident. It is essential for any surviving family member considering a claim to act quickly and retain legal counsel immediately.

Under California law, specific individuals are granted priority for claims for wrongful death. Generally, the first candidates include the decedent’s spouse, domestic partner, or children. If such close relatives are non-existent, then other family members may be eligible to file a claim. This may include the deceased’s putative spouse, parents, and other kin. Finally, any relative who can establish that they depended on the decedent for financial support may pursue a claim. To determine your eligibility, contact our legal team for a free consultation.
