Rosemont Multiple Vehicle Accident – A Rosemont multiple vehicle accident along Highway 50 on November 7, 2018,  resulted in numerous injuries, and one person was transported to a nearby hospital for further evaluation and treatment. According to the California Highway Patrol (CHP), the collision was initially said to have involved three to four vehicles, which was upgraded later to seven cars. The CHP will be conducting an investigation into the crash to determine fault and how the accident occurred.

Rosemont Multiple Vehicle Accident Details

The collision occurred along eastbound U.S. 50 just west of the on-ramp for Bradshaw Road North at around 7:30 in the morning. It was initially reported that three sedans were involved, including a Honda, and one of the other vehicles was a Lamborghini. The collision blocked lanes one through three, with several of them ending up facing in the wrong direction. Traffic was backed up to downtown, along with the eastbound lanes of U.S. 50. A SigAlert was issued, telling motorists that they may experience heavy traffic congestion and delays in the area, urging local drivers to use an alternate route. The lanes were reported as cleared shortly before 9:00 a.m. No further information has been released on those who were involved in the accident or the extent of their injuries.

Vehicle B comes to an abrupt stop, and C plows into the rear bumper. This pushes B into the lead vehicle A. Most people would automatically say that the rear vehicle C was at fault. But, consider that there may be mitigating circumstances.

The mid vehicle B stopped abruptly, causing C to have no place to go and precipitated the accident. This can be used as a defense for the driver in the rear vehicle. However, he or she should have maintained an appropriate speed and distance between their auto and the one in front of them, allowing the vehicle to stop in time. Let’s make it a little more complicated. What if B had non-working brake lights. This would have further hindered the situation since C would not have had any reason to expect the vehicle to stop. However, the brake lights might have been defective, relinquishing some of the blame from the driver. Driver A was not at fault in the accident, since the driver slowed due to changes in traffic and had working brake lights.

How to Assign Fault in a Rosemont Multiple Vehicle Accident

In the accident described above, both drivers C and B are partially at fault for the accident. If the case is taken to court in California, the jury will assign the percentage of liability. Driver C may have 70 percent liability in the collision while driver B may be 30 percent at fault. This means, under California’s rule of comparative fault, driver B will receive 70 percent of his or her damages while driver C will receive 30 percent of theirs. If the brake lights were defective, the manufacturer of this auto part might be named in the lawsuit.
