Motorcycle Accident Fatally Injures Ceres Man

A Ceres man passed away in a motorcycle accident near Jamestown on the evening of March 13, 2019. The crash happened shortly before 6:30 p.m. along Highway 120 in the vicinity of O’Byrnes Ferry Road. A man riding a Yamaha motorcycle reportedly entered the oncoming traffic lane to overtake a slower-moving vehicle. While doing so, he was struck by a driver of a Chevrolet Suburban who was also in the process of passing slower traffic. The impact of the collision caused the man to be ejected from the Yamaha, and he landed in the grass and dirt shoulder. The motorist and passenger of the Chevrolet Suburban were uninjured in the crash. Sadly, the biker was pronounced deceased at the scene. Officials have identified the decedent as 45-year-old Joshua Cody Boykin of Ceres. I would like to send my healing thoughts and prayers to the friends and family of Mr. Boykin in their time of loss and sorrow.

Accident Investigation

The cause of the motorcycle crash is unknown due to an ongoing investigation. However, drugs or alcohol were not believed to have been factors in the accident. Moreover, a GoFundMe page has been established by the loved ones of Josh Boykin to help cover his funeral expenses. The remainder of the proceeds will be placed in a trust for Mr. Boykin’s newborn son.

Who is at Fault in a Motorcycle Accident?

Most motorcycle accidents are caused by driver error. In other cases, liability for a motorcycle collision may be attributed to a biker. Examples include when the motorcycle rider is driving impaired or speeding. Since California is a comparative fault state, this means each party would only be able to recover a portion of the compensation awarded based upon the percentage of negligence assigned to them. For instance, if a biker is 30 percent at fault for a crash, he or she would only be able to claim 70 percent of damages incurred. Liability can be complicated to determine in a motorcycle crash. For this reason, it is essential to seek assistance from an experienced Modesto motorcycle accident lawyer. An attorney can ensure a biker’s right to fair compensation will be protected.

What are the Most Common Motorcycle Accident Injuries?

Motorcycle accidents are severe and can lead to some significant injuries. It is crucial for those involved in these collisions to seek medical treatment promptly, regardless of how minor the injuries may seem. Injuries commonly suffered in these crashes include burns, bone fractures, road rash, facial fractures, and disfigurement. Other common motorcycle accident injuries can range from minor to severe, such as concussions, amputations, traumatic brain injuries, spinal cord trauma, and wrongful death.

Wrongful Death in a Motorcycle Accident

The negligence of another driver can change a person’s life in the blink of an eye. In other cases, they may claim the life of a loved one. When this happens, the surviving family members of the decedent may seek compensation for their losses. Damages may include end-of-life medical expenses, costs of a funeral and burial, emotional distress, loss of future income and services for the household, and more. View the video below to learn which family members may be eligible to file for wrongful death.
