Manteca Fatal Accident Train Kills Man

Manteca Train Accident Fatally Injures Man

A pedestrian suffered fatal injuries after being struck by an oncoming train near the South Main Street crossing in Manteca on July 21, 2018. At approximately 11:00 in the evening, officers from the Manteca Police Department responded to a report of an incident involving a Union Pacific Railroad train and a pedestrian. Upon arrival, officers located an adult male in an area north of the railroad tracks along the center median. Sadly, the man was pronounced deceased at the scene by emergency personnel. Authorities have identified the victim as 28-year-old Luis F. Barron of Manteca.

I would like to send my thoughts and prayers to the friends and family of Mr. Barron as they mourn their loved one’s death.

Train Accidents

Trains are likely to result in serious injuries or even death as a result of an accident due to their sheer size. Government entities estimate that 900 individuals suffer injuries and 250 more are killed in the United States every year due to train accidents. When a train accident causes injuries to another party, the train company may be held responsible for damages incurred. Contact an experienced personal injury lawyer for more information.

Due to the overwhelming size, weight, and speed carried by trains, devastating injuries are likely to result. Some of these injuries may include:

  • Amputation
  • Bone Fracture

Recoverable Damages in a Wrongful Death Claim

For those who have lost someone they love, understanding wrongful death is a crucial step. A wrongful death in California is defined as the loss of life due to the wrongful or negligent act by another person or entity. Those who meet the requirements of California Code of Civil Procedure 377.60 may recover damages in a wrongful death claim such as:

  • Funeral and burial expenses
  • End of life medical care, which is recoverable in a survival action
  • Benefits lost such as retirement income that a decedent would have received had he or she lived
  • Loss of future earnings and inheritance
  • Financial support and household services that were provided by a decedent
  • Loss of companionship, love, affection, and guidance
  • Emotional distress caused by the loss

How a Train Accident Lawyer Can Help

Train accidents can leave victims with serious or even fatal injuries, including pedestrians and bystanders. When these types of accidents happen, negligence must be proven in order to recover compensation. This can be done by showing that a defendant, such as train conductors or entities that own the train lines, breached their duty of care owed to an injured party. Since railroad companies are large companies, they often take quick action as a way of limiting their liability to pay out as little as possible for resulting losses. If you or a loved one have been injured in a train accident, retaining an experienced train accident lawyer in Manteca is crucial to protect your right to fair restitution.
