Auto Accident Fatally Injures Child Near Linden

I’m Ed Smith, a Stockton personal injury lawyer. Recently, a young child passed away in a head-on collision west of Linden. The crash took place along a straight stretch of Highway 26 between Murray Road and Jack Tone Road at approximately 11:15 in the morning. An eastbound silver Toyota was on the highway when a westbound Gold Cadillac drifted into the eastbound lane and collided with the Toyota head-on. The impact propelled the Toyota off the south side of the road where it came to a rest after crashing into a power pole while the Cadillac continued on the north side and struck a mailbox. Medical personnel was called to the scene to perform lifesaving efforts on a child who was restrained in a safety seat in the Toyota. Unfortunately, their efforts were unsuccessful as the child was declared deceased at the scene.

Our thoughts and prayers go out to the friends and family of the young child during this tragic time.

Accident Investigation

The area was closed down for nearly three hours as the California Highway Patrol (CHP) investigated the cause of the crash. Initial reports by CHP indicated that drug or alcohol impairment was not believed to be factors in the crash.

How do Head-On Collisions Happen?

Head-on collisions transpire when two vehicles traveling in opposite directions strike one another. These accidents can lead to serious injuries and high property damage due to the area of impact and rate of speed by each car. Oftentimes, head-on collisions occur as a result of negligence such as driving on the wrong side of the road, driving while intoxicated and distracted driving. When involved in such accidents, negligence or recklessness must be proven on part of the responsible party in order to recover for resulting damages.

How a Wrongful Death Lawyer Can Help

A thorough investigation of a head-on collision is crucial in determining whether one driver was at fault or whether both motorists shared liability in the accident. When one of the drivers is shown to be negligent and their actions caused the death of another, a wrongful death claim may be brought against them. These claims can recover financial damages resulting from wrongful death such as the costs of a funeral and burial, loss of future support the decedent would have provided to his or her family and end-of-life medical expenses if the victim lived for a time before succumbing to his or her injuries. Although no amount of money can bring your loved one back, contacting an experienced wrongful death lawyer in Stockton can help you rebuild your life after your tragic loss.

Coping with the Loss of a Child

No parent should ever have to experience the loss of a child. When a child loses their life, grieving parents face the challenge of living without their loved one by their side, which can be a daunting and overwhelming task. Although pain will less over time, the thought of a late child will never be far from a parents’ heart. If you have lost someone close to you, always remember how much they cared about you and how they could never bear to see you suffer.
