Stockton Motorcycle Accident Fatality

Stockton Motorcycle Accident Fatality

I’m Ed Smith, a Stockton personal injury attorney. Authorities reported that a motorcycle accident had taken place northeast of Stockton during the afternoon of Sunday, April 1, 2018. Unfortunately, a motorcyclist suffered fatal injuries following the collision.

Our thoughts and prayers are with the family members of the party who passed away in this devastating motorcycle accident.

What Happened?

Officers from California Highway Patrol (CHP) came to the site of an accident involving a motorcycle rider. The location was described as the southbound lanes of Highway 99 in the vicinity of Wilson Way. The time was approximately 2:50 pm. Upon initial investigation, officials indicated that the biker approached a slight curve in the roadway while riding a 2007 Harley Davidson motorcycle. For unknown reasons the biker lost control. The motorcycle collided with the guardrail and the impact propelled the cyclist onto the highway. The motorcycle came to a stop in the No. 3 lane of traffic. Crews closed down the third traffic lane for two hours to investigate the tragedy. No other individuals or vehicles were reported to have been involved in this accident.

Nature of Injuries

Medics rushed to the scene to perform life-saving measures to revive the motorcyclist. Unfortunately, their efforts were unsuccessful. The biker was pronounced deceased at the scene.

What Caused the Accident?

The cause of the motorcycle accident is being investigated by the CHP. A report usually released about 10 days after the accident. Authorities have not yet decided whether alcohol or drugs played as factors in the fatal accident.

Motorcycle Accident Statistics

According to a 2014 collision data report by the National Highway Safety Traffic Administration (NHTSA), motorcyclist fatalities occurred twenty-seven times more often than deaths in other vehicles. Approximately 4,586 bikers lost their lives in traffic collisions in 2014, a notable decrease from 4,692 in 2013. The report also indicated that 43 percent of fatally injured riders in single-vehicle accidents were reported as being under the influence of alcohol at the time of the crash. Motorcyclists are advised to always ride sober and wear motorcycle helmets that are in compliance with U.S. Department of Transportation (DOT) regulations to ensure their safety.

Injuries and Deaths Resulting from Motorcycle Accidents

A motorcycle accident has the potential to cause serious injuries to a biker, ranging from bone fractures and spinal cord damage to internal organ trauma and traumatic brain injuries. A victim who has suffered any of these types of injuries can undergo a long period of rehabilitation that is oftentimes compounded by mounting medical bills and financial losses. If a wrongful death is caused by the negligence of another party in a motorcycle accident, the family of the victim may recover for the following damages:

  • Loss of affection, consortium, comfort and moral support
  • Loss of inheritance
  • Future financial support loss
  • Funeral and burial expenses
  • Household services loss
  • Loss of parental care, training, and guidance

There is a strict limit on the time in which parties directly related to the deceased may file a wrongful death claim in California. The statute of limitations is two years from the date of the individual’s passing. If a government entity is involved, the time to file may be drastically reduced. An attorney with years of experience can guide a family through the process of filing a claim against the responsible party for their loved one’s wrongful death.
