I’m Ed Smith, a Vacaville personal injury lawyer. On Monday, November 27, 2017, Kenneth S. Montgomery, a 37-year-old man who is accused of striking a husband and wife who were riding a motorcycle was ordered to stand trial for charges of felony hit-and-run and assault with a deadly weapon.

The Accident

During a probable cause hearing, the couple stated that they had been on a ride from their San Mateo home to Reno and had been just east of Vacaville when they noticed Montgomery’s Volkswagen Passat driving in the fast lane of the highway. The time was approximately 10 a.m.

An eyewitness told the court that he saw the Volkswagen speed up within a short distance of the couple’s motorcycle before it crossed into the center divider and briefly drove alongside the motorcycle at 75 miles per hour. After this, the eyewitness said that the Volkswagen suddenly veered to his right, colliding with the motorcycle.

The impact of the collision caused the couple on the motorcycle to be ejected. They reportedly slammed to the asphalt in front of the eyewitness, who said that he only barely avoided running over the couple.


The driver of the motorcycle testified that he had sustained a broken collarbone, broken shoulder, six broken ribs, and a ruptured spleen as a result of the collision. Reportedly, the man stood up to show Judge E. Bradley Nelson the scars on his arms from the numerous lacerations and abrasions he sustained in the crash.

The wife testified that the accident left her with a puncture wound in her leg, serious cuts on her hands, and a broken wrist.

Hit-and-Run and Arrest

After striking the couple and demolishing their motorcycle, the Volkswagen drove away without stopping at all.

A California Highway Patrol (CHP) officer told the court that Montgomery pulled off of the freeway close to the outskirts of nearby Dixon and reported to a CHP officer involved in an unrelated traffic stop procedure that he had seen a serious collision. Montgomery was arrested on the spot after he was unable to explain why other motorists had described seeing him driving erratically alongside the motorcycle.

Montgomery has been in jail since the arrest.


On Monday, Nelson officially ordered that Montgomery would stand trial on three separate felony charges and doubled his bail, which now stands at $120,000. Montgomery is required to return to court on December 11, 2017, when a trial date will be set. If he is convicted for all of the charges, he will face up to 12 years in state prison.
