Drunk Driving Crash Fatally Injures Merced Man Near Delhi

I’m Ed Smith, a Merced wrongful death lawyer. A group of four men were driving together near Delhi onthe afternoon of Sunday, November 19, 2017. Unfortunately, this would be the last ride the men would take together due to an alleged drunk driving accident.

What Happened?

A man was driving his 2006 Nissan Titan along the Golden State Boulevard overpass at approximately 4:30 pm. The Nissan veered off the roadway and collided with a guardrail. The impact of the collision caused the vehicle to overturn off the bridge and came to a rest on its roof along Highway 99.

Nature of Injuries

There were four occupants inside the Nissan Titan at the time of the accident. The driver suffered a wrist fracture and received treatment at an area hospital. Two male passengers sustained major injuries and were transported via air ambulance to a hospital in Modesto for treatment. The other male passenger, sadly, passed away due to the severity of his injuries.

Identity of Victim

The Merced County Coroner’s Office has identified the victim of the accident as 45-year-old Thomas Gonzalez of Merced.

What Caused the Accident?

Reports from the California Highway Patrol (CHP) revealed that the motorist of the Nissan Titan was allegedly driving under the influence of alcohol at the time of the accident. The driver, identified as 41-year-old Kevin Mitchell Hernandez, was arrested on suspicion of drunken driving causing death and vehicular manslaughter. After receiving treatment for his injuries, he was booked into the Merced County Jail. Hernandez may face more charges as the investigation continues.

Drunk Driving Statistics

Accidents involving drunk drivers happen more often than we think. A 2015 Centers for Disease Control and Prevention (CDC) revealed that 10,265 parties passed away in drunk driving accidents. This number accounted for 29 percent of all traffic-related fatalities in the nation. Approximately 1.1 million motorists were detained for driving under the influence of alcohol that same year.
