What Happened?

A 25-year-old Delhi man was driving his 1997 Ford Taurus southbound along First Street in the vicinity of Cedar Avenue at approximately 5:00 pm. The man allegedly began to have a seizure, causing him to lose control of his vehicle. A 26-year-old Delhi woman in the passenger’s seat of the Ford began steering the car and blaring the horn to alert other motorists. Unfortunately, this attempt was unsuccessful. The Ford collided with a 2016 Hyundai Elantra that was traveling eastbound along Atwater Boulevard. The Ford drifted off the roadway and into the garage of Moores Automotive on Atwater Boulevard.

Was Anybody Injured?

The 22-year-old Atwater woman driving the Hyundai and her 24-year-old passenger complained of pain following the car accident. They were both transported to the Memorial Medical Center in Modesto. There were two young children riding in the Ford at the time of the crash. The children along with the Delhi man and woman were all transported to the Mercy Medical Center in Merced for treatment of their injuries.

DMV Medical Probations Regarding Lapse of Consciousness Disorders

The State of California Department of Motor Vehicles (DMV) monitors the status of vehicle registration and driver licenses closely. When a driver is found at-fault in a car accident, they may receive penalty points on their driving record based on the severity of the collision. When points begin to add up, this oftentimes results in higher automobile insurance rates for that driver or even license suspension or revocation. This also applies to DMV’s guidelines on medical probations.

When a driver suffers from a medical condition leading up to a car accident, there are guidelines the DMV follows to evaluate a motorist with a lapse of consciousness disorder. These actions are listed as followed:

  • No Penalty
  • Type II Medical Probation
  • Type III Medical Probation
  • License Suspension
  • License Revocation

The DMV has the power to place a medical probation on a person’s driving privilege under California Vehicle Code Section 14250. This law is not only intended to ensure the safety of that person but also others traveling on the roadway. In order to lift a medical probation, a person must complete a Driver Medical Evaluation. If fraudulence is suspected, this can result in a rescheduled reexamination or immediate driving privilege suspension.
