Auburn Front End Collision Ends in Driver’s Death
I’m Ed Smith, an Auburn car accident lawyer. A front end collision along California State Route 49 on the north side of Auburn killed one of the drivers involved in a head-on crash on Friday, June 16. Highway traffic was slowed down to one lane because of the accident, and traffic was allowed to pass during alternating intervals.
I want to extend my prayers and sympathy to the family of the person who was killed in this, their time of sorrow and loss.
Details of the Accident
The California Highway Patrol reported that the crash happened at around 8:30 in the morning on the highway north of the city when a minivan, driving north, crossed over into the opposing lane. At this point, the minivan struck a car that was traveling south head-on. The crash caused the death of the person whose vehicle was struck. The minivan driver suffered injuries described as minor.
Common Types of Accidents
Head-on collisions are one of the many common motor vehicle accidents. When an individual inside a car sees an accident coming, it may give them an opportunity to brace themselves for the impact. However, on many occasions no forewarning is given. Catastrophic injuries frequently occur from head-on collisions and may cause head injuries, back injuries and soft tissue damage due to the effect of the seat belt upon impact.
Wrongful Death Accidents
Head-on collisions often involve a driver moving into oncoming traffic and striking another vehicle. This negligence commonly ends in traumatic injury to the occupants of the struck vehicle. The decedent’s family, putative spouse, stepchildren or parents are able to file a wrongful death lawsuit against the at-fault party.
Recoverable damages in a wrongful death case include:
- Funeral and burial costs
- Loss of financial support in a household in the future
- Loss of parental guidance and care
- Hospital expenses prior to the decedent’s death
- Inheritance loss
- Loss of moral support and companionship
- Loss of consortium for a spouse
The family can also file a personal injury lawsuit in the name of the decedent since personal injury can survive death. This is called a survivor action. In this case, the injury to the decedent of the pain he or she experienced prior to death and the knowledge of impending death is the basis of the lawsuit against the defendant.
