Driver Injured in Ojai Single-Vehicle Crash
I’m Ed Smith, an Ojai car accident lawyer. A single-car accident in Ojai on Monday, March 20, 2017 sent its injured driver to the hospital. Results are pending as to the person’s condition at the time of this report.
About 2:32 in the afternoon, a driver in a black car crashed into a tree at the intersection of East Villanova Road and Ventura Avenue/Highway 33, causing the vehicle to roll over. The vehicle’s occupant was able to get out of the car and, according to a spokesperson for the Ventura County Fire Department, was transported to the Ventura County Medical Center after suffering moderate injuries. One individual reported that the vehicle was in an upside-down position and badly damaged, with the windows broken out and wheels missing. No further information is available at this point as to the cause of the accident.
Liability in Single-Vehicle Crashes
The assumption might be made that a single-vehicle crash is the fault of that vehicle’s driver. This is not always true. There are other reasons the accident might happen.
The first possible scenario is that another vehicle was involved. In such cases, that second vehicle’s driver might have precipitated the crash by acting negligently even though there was no collision between the vehicles. It is important to document how the accident happened and procure basic information from the driver of the second vehicle. If the driver leaves the scene of the accident, this could be considered a hit-and-run case.
In another instance, the driver might experience equipment failure, causing the accident. This might be the result of faulty brakes, defective equipment such as the ignition switch or tire blowout. Using accident reconstruction efforts, it is possible to determine what happened just prior to the crash. This could result in a product liability lawsuit against the manufacturers or distributors.
Evidence Is Important
It is important to explain how the accident happened to the police. If another car was involved and left, make sure you describe as much as you can about the vehicle. This will help the police apprehend the driver.
In the event the accident was caused due to mechanical failure, note what happened and tell your attorney. Research might indicate that recalls were ordered on the vehicle, and you were not notified. In addition, the vehicle can be checked by a qualified mechanic.
