Modesto Crash Kills Woman

I’m Ed Smith, a Modesto Car Accident Attorney. In the early morning of Tuesday, September 27, 2016, a motorist was stopped at the intersection of Maze Road and Highway 132. Approaching from the west was a truck that was traveling around 55 miles per hour. Within moments a terrible crash took place.

What Happened?

Shortly after 3:30 a.m., a 23-year-old Modesto woman, Olai Phompong, was traveling north on Paradise Road in a 2008 Toyota Prius. She was approaching a stop sign at Highway 132 and Maze Boulevard. Traveling westbound, was Luciano Enriquez of Oakdale. Enriquez was traveling at approximately 55 miles per hour in a 2011 three-axle Volvo truck tractor, which was pulling a trailer, according to authorities from the California Highway Patrol (CHP). The driver of the Toyota Prius pulled out into the intersection directly in the path of the Volvo truck. The driver of the Volvo truck hit his brakes, but was unable to avoid a collision. The front of the truck hit the driver’s side of the Toyota Prius.

Woman Driving Toyota Prius Fatally Injured

When authorities arrived on scene they discovered the Toyota Prius at Paradise Road and Maze Boulevard blocking traffic. Sadly, Olai Phompong, the driver of the Prius, was pronounced dead at the accident scene.

Was the Truck Driver Injured?

No. Enriquez was able to  stop his truck along the shoulder of Maze Boulevard. He did not suffer any injuries as a result of the collision.

What Caused the Accident?

The CHP is investigating the cause of the collision. Preliminary findings exclude drugs and/or alcohol as a contributing factor to this motor vehicle accident.

Could This Be a Dangerous Intersection?

An accident almost identical to this one took place in the early morning hours of August 24, 2016. In that accident, Jose Calderon, a 26-year-old Modesto man, was traveling northbound on Paradise Road After coming to a stop at the intersection of Maze Boulevard. He proceeded forward pulling right into the path of a Volvo tractor-trailer traveling eastbound.

Dangerous Intersections & California Tort Claims Act

For someone interested in determining whether a dangerous road condition caused their auto accident it is important to contact a government entity road defect lawyer. Especially, if the accident resulted in serious injuries or some has passed away. These type of claims can be very complex and time consuming. It very important to be aware that suing a governmental entity under the California Tort Claims Act (CTCA) requires a person to file a claim within 6 months or 180 days, from the date of their wrongful death or injury. The statute of limitations on this type of claim, is dramatically shorter than other personal injury claims, which are generally two years. Although the given reason for this shortened time in which to file a claim is to give the government proper notice of any defects or dangers it needs to be aware of, and to allow the entity to budget for any trials or settlements, in reality, it allows the government to have a great advantage over a public that is mostly unaware of the reduced amount to time to file a claim.
