Southbound Highway 5 Closed

I’m Ed Smith, a Sacramento Car Accident Lawyer. Southbound Highway 5 closed today near Seamus Avenue in Sacramento. This is an area prone to a high number of vehicular accidents.

Skid Testing

California Department of Transportation is asking drivers to find alternate routes so they can perform skid testing. As you will recall, this is an area of Interstate 5 that has had multiple big rig accidents as well.

Closure Hours

The two right lanes will be closed from 8:00 am to 11:00 a.m. The fast lane will be closed from 11:00 a.m. to 2:00 p.m.

Recent Highway 5 Accidents

On December 10, 2015, a Federal Express truck driver lost control of his big rig and crashed into a pick up truck being driven by a man from Elk Grove. The man from Elk Grove lost his life in that tragedy.

On December 21, 2015, there were two big rig crashes that happened in close proximity of each other but at different times. Those accidents shut down Highway 5 near Sutterville Road and 47th Avenue in both directions.

Government Entity Claims for Highway Defects

As a Sacramento Auto Accident Attorney for the past 33 years, I have helped numerous clients bring successful claims against their government entities for traffic collisions caused by dangerous road defects and conditions.  Some of these roadway hazards which can cause car accidents and create a liability for our government are:

  • lack of the presence of guard rails
  • highway shoulders that are inadequate
  • intersection obstruction
  • improper lane width (too narrow)
  • merge lanes that are poorly designed
  • road construction debris that makes an area hazardous
  • lack of or insufficient warning signs
  • large potholes
  • other severe roadway defect

Suing a Government Agency

Bringing a lawsuit under the California Tort Claims Act or CTCA is different than other lawsuits. In government entity lawsuits you are required to file a claim within 180 days (6 months) from the date of your injury or the death of your loved one.  In personal injury claims,  you generally have two years to file.  If you have a government entity claim you must be aware of the 180 day time constraint to file your claim. This really gives the government a huge advantage over the general public that is mostly unaware of this time constraint.
